Welcome to artradie.

These Terms & Conditions (“Terms”) govern your access to and use of the artradie website (“Website”), operated by artradie Limited (“artradie”, “we”, “our”, or “us”).

By accessing or using this Website, creating an account, submitting artwork, or purchasing artwork, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Website.

These Terms apply to all users of the Website, including visitors, buyers, artists and registered account holders. 

1. About artradie

artradie is a curated online gallery representing original artwork created by New Zealand artists.

Unlike a traditional online marketplace, artradie manages the presentation, marketing and sale of artworks on behalf of participating artists.

Artists retain ownership of their artwork until a sale has been completed.

artradie acts as an agent for participating artists and facilitates the sale of artwork through the Website.

We reserve the right to curate the artworks displayed on the Website and may accept, decline, remove or suspend artworks or artist profiles at our discretion.

2. Changes to These Terms

We may update these Terms from time to time.

Any changes become effective when published on this Website.

Your continued use of the Website after changes have been published constitutes acceptance of the revised Terms.

3. User Accounts

You may browse the Website without creating an account.

Artists wishing to sell work on artradie must complete the official online submission process and establish an approved Artist Profile.

An account is required to purchase artwork, save favourites or access certain services.

You agree to:

  • provide accurate information
  • keep your information up to date
  • keep your login credentials secure
  • notify us immediately if you suspect unauthorised access to your account.

You must be at least 18 years old to purchase artwork or submit artwork for consideration.

4. Artist Applications

Artist applications begin with an expression of interest (EOI). Successful EOI applicants will receive an official Submission Pack outlining how to formally submit specific artworks for curatorial consideration for inclusion in upcoming collections.

Submitting an application to become an artradie artist does not guarantee acceptance.

Applications are reviewed by our curatorial team.

Acceptance is based on a range of factors including artistic quality, originality, suitability for current collections and the overall balance of the gallery.

We reserve the right to accept or decline applications at our discretion and are not obliged to provide reasons for our decision.

Accepted artists may be invited to submit artworks for future collections.

Acceptance as an artradie artist does not guarantee that every submitted artwork will be exhibited or offered for sale.

5. Artwork Listings

Artists warrant that:

  • they are the creator of the artwork or have the legal authority to sell it
  • the artwork is original unless clearly identified otherwise
  • all information provided is accurate
  • pricing is accurate
  • submitted images accurately represent the artwork
  • the artwork complies with all applicable New Zealand laws.

Artists agree to promptly notify artradie if a listed artwork becomes unavailable or is sold elsewhere.

artradie may edit artwork descriptions, titles, categories or images for presentation, accessibility and marketing purposes while preserving the integrity of the artist’s work.

6. Purchasing Artwork

When you purchase artwork through artradie, you are purchasing artwork that artradie represents on behalf of the artist.

All payments are processed securely through approved payment providers.

Ownership of the artwork transfers to the purchaser once payment has been received in full and the artwork has been delivered, subject to any applicable rights under New Zealand consumer law.

Availability of a specific artwork is subject to confirmation by the artist.

If an artwork is no longer available before dispatch, artradie may cancel the order and issue a full refund.

7. Pricing and Payments

All prices displayed on the Website are in New Zealand Dollars (NZD) unless otherwise stated.

Artists determine the retail price of their artwork, subject to artradie’s curatorial policies.

Payment is collected by artradie. Upon successful completion of the 7-day customer verification window, funds will be distributed to the artist. The artist receives 75% of the retail sale price, and artradie retains a flat 25% service fee (plus GST) to cover marketing, platform management, and sales administration.

8. The End-of-Season Auction

To maintain a dynamic rotation across artadie’s exhibition cycles, artworks reaching the end of their active collection window without a sale may be eligible for entry into a curated online auction hosted by artradie. Participation in any auction is entirely optional and remains subject to the artist’s explicit consent, pre-agreed reserve pricing, and separate auction terms.

9. Shipping and Delivery

Direct Artist-Buyer Logistics: artradie operates solely as a curated gallery platform and is not a party to the shipping or delivery transaction. Once a sale is processed, artradie will securely share the buyer’s delivery information with the artist. All shipping arrangements, packaging, carrier selection, and delivery tracking must be managed directly between the artist and the buyer.

Artist Responsibilities: Artists are responsible for securely packaging sold artworks and coordinating dispatch directly with the buyer in a timely manner.

Buyer Responsibilities: Buyers are responsible for confirming to artradie within the 7-day customer verification window that the artwork has been received. If there are issues with the artwork, artradie must be notified within this same 7-day verification window.

Risk and Liability: To the maximum extent permitted by New Zealand law, artradie assumes no liability for artworks that are damaged, lost, or delayed in transit. Risk during transit remains entirely between the artist, the buyer, and their chosen courier service.

10. Returns and Refunds

Returns, refunds and damaged artwork claims must be lodged within our strict 7-day customer verification window following successful delivery of the artwork to the buyer.

Where an artwork arrives damaged or materially differs from its description, buyers should contact artradie as soon as possible.

artradie will work with both the buyer and artist to resolve the matter fairly.

Nothing in these Terms limits any rights available under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

11. Intellectual Property

Artists retain copyright and intellectual property ownership of all artworks and images they submit.

By submitting artwork, artists grant artradie a non-exclusive licence to display, reproduce and promote artwork images for the purposes of marketing, selling and promoting the artist and the Website.

Website content, branding, logos, graphics and design remain the property of artradie unless otherwise stated.

No content may be reproduced without prior written permission.

12. Acceptable Use

Users must not:

  • submit misleading information
  • infringe copyright or intellectual property rights
  • upload unlawful or offensive content
  • interfere with Website security
  • attempt to access restricted areas
  • impersonate another person or organisation
  • use the Website for fraudulent activity.

We reserve the right to suspend or terminate accounts that breach these Terms.

13. Liability

To the maximum extent permitted by New Zealand law, artradie shall not be liable for indirect, incidental or consequential losses arising from use of the Website.

Nothing in these Terms excludes any rights that cannot legally be excluded under New Zealand law.

14. Governing Law

These Terms are governed by the laws of New Zealand.

Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the New Zealand courts.
